Entebbe Magistrate Grade one Her Worship Stella Okwanga Pacular has on Wednesday charged reown Pastor Aloysius Bugingo and his new lover, Suzan Makula Bugingo with three charges under the marriage Act.
It should be recalled that lawyer Male Kiwanuka Mabirizi sued the pastor and his new lover accusing them of contracting marriage by customary law under the marriage Act cap 251 contrary to section 50 of the marriage Act , cap 251.
During the hearing, court heard that on 7th December, 2021, while at Kawuku, Katabi Town Council, Wakiso District, Pastor Bugingo, also a lead Pastor at the House of Prayer Ministries International having contracted marriage under the marriage Act, cap 251 with Teddy Naluswa Bujjingo and during the continuance of that marriage, did contract another marriage in accordance with the customary law with Suzan Makula Nantaba.
Court further found Makula guilty of an offence of Bigamy after she got married to a person she knew was previously married to Teddy Naluswa Bujjingo contrary to section 153of the penal code Act, cap 120.
The couple were found guilt of contracting marriage by customary law when already married under the marriage Act, Mariage with a person previosly married and Bigamy contrary to section 153 under the Penal Code Act.
This was after being satisfied that the customary marriage ceremony took place as confirmed by Bwerenga LC1 Chairman, Emorit Joseph .
The Director of Public Presecution (DPP) represented by Ddamba Makula said they will not take over the case.
Bugingo and Makula who did not appear befor court in person were represented by their lawyer, Ronald Ruhinda.
The magistrate has summoned Pastor Bugingo and Suzan Makula to appear before court to take plea of the charges against them on January 21, 2021.
