The Court of Appeal has for the second time declined to stay an 18 months imprisonment sentence handed to Lawyer Male Mabirizi for insulting Justice Musa Ssekaana .
Instead Justices ; Muzamir Kibeedi, Irene Mulyagonja and Eva Luswata have advised Mabirizi to go and seek pardon before justice Ssekaana or continue serving his jail term until the final disposal of his appeal .
Mabirizi had asked the justices to reverse the decision of their fellow judge Christopher Madrama who ruled February that he can not set Mabirizi free before going through proper channels to challenge his sentence .
In the same case , the three justices have have ruled that they cannot tamper with Mabirizi’s conviction and sentence unless he files a formal appeal to have his grievances addressed.
The justices have also invoked their powers to struck out other 8 pending applications for Mabirizi for purposes of creating room for other litigants and to reduce case backlog.
Mabirizi was imprisoned for his continuous attack and insult to judicial officers contrary to prior court warnings and orders to desist from the same.
On top of serving his one and half years sentence , Mabirizi was also slapped with a 300m shillings fine for contempt of court
