The National Resistance Movement candidate in the Mbale city woman MP in the January elections, Lydia Wanyoto Mutende has threatened to petition the court of appeal opposing the decision by the Mbale High Court to dismiss her petition challenging the election of Hon. Connie Galiwango.
On Thursday, the Mbale High Court judge Byabashaija Andrew dismissed with costs an election petitionn inwhich Wanyoto was challenging the election of Galiwango (Independent-NRM leaning) as the Woman Member of Parliament for Mbale city.
“The second respondent (Galiwango) resoundingly won the election with 40,729 votes against the 25,276 votes. That is a wild margin given that there were four other candidates in the race. The success of such a winning candidate at election cannot be interfered with or taken away without any justification. It should be upheld, having found that the petitioner is not entitled to any remedies. The petition is therefore, dismissed in its entirety with costs to first and second respondent,” Justice Andrew Byabashaija ruled.
Dissatisfied with the ruling, Wanyoto issued a notice of appeal to the High Court registry in Mbale stating that she was not in agreement with the entire decision and orders of the judge.
“Take notice that the petitioner/intended appellant being dissatisfied with the judgement of His Lordship Hon. Dr. Justice Bashaija K Andrew delivered at Mbale on the 30th September,2021, in the above mentioned petition intends to appeal to the court of Appeal of Uganda against the entire decision and orders of the judge in the said matter,” read notice of appeal lodged in the High Court registry at Mbale.
The notice according to the appellant’s lawyers of Nangulu Mugoda Advocates, will also be served to the respondents (the EC, Nakayenze Connie Galiwango) lawyers i.e the Electoral Commission, Dagira and Co Advocates Mbale and Lukwago and Co. Advocates Kampala.
