The National Unity Platform president, Robert Kyagulanyi Ssentamu has demanded that three supreme court judges justices; CJ Owiny-Dollo, Mike Chibita and Ezekiel Muhanguzi recuse themselves from his petition challenging president Museveni’s victory in the 2021 elections.
According to Kyagulanyi, Chief Justice Owinyi Dolo who served as Museveni defense lawyer in the 2006 during a similar petion in which Dr. Besigye challenged Museveni’s victory, Mike Chibita who worked as Museveni private secretary for 7yrs and Ezekiel Muhanguzi, a close relative to Security minister Gen. Elly Tumwine, may have conflicts of interest and lack confidence in the case.
He made remarks while addressing a weekly presser at the party Headquarters in Kamwokya Kampala.
On Thursday, city Lawyer Male Mabirizi petitioned Chief Justice Owinyi Dolo requesting him to recuse himself from the Kyagulanyi petition citing out similar reasons.
However, the NRM party legal director, counsel Oscar Kihika, dismissed the requests saying that CJ Owinyi Dolo will not recuse himself from the Kyagulanyi petition stating that Lawyer Male Mabirizi’s petition does not meet standard requisite.
“Kyagulanyi’s petition filed on Monday February 1st, 2021, seeks annulment of the results of last month’s presidential election that handed incumbent Yoweri Museveni the victory, citing 26 grounds on which they base their petition, including ballot stuffing, intimidation of NUP agents and supporters, pre-ticked ballot papers, voter bribery and others.”
Kyagulanyi further threatened to withdraw his petition if the supreme court continues blocking their evidence.
“I am warning the supreme court that if they continue blocking our evidence we shall withdraw our case from court and take the matter before the public court,” Kyagulanyi said.
Supreme court had given upto February 14th (last Sunday) to Kyagulanyi legal team to submit in affidavits of their evidence in the case.
On the continued kidnap of NUP supporters, Kyagulanyi says he will on Wednesday present a petition to the United Nations (UN) at their office in Kampala about the ongoing “kidnaps and violation of human rights by the regime.
He appealed to the families whose members have been kidnapped to join them tomorrow to present a petition.
